Bucs MRSA Case Headed Back to State Court

The former Bucs kicker, Lawrence Tynes, who is suing the Tampa Bay Buccaneers scored a victory in Federal Court when that Court decided to remand the case back to State Court.  The kicker claims that he contacted MRSA as a result of the negligence of the Bucs training staff and an unsafe training facility.  The infection eventually cost the kicker his career.  The kicker sued in state court, but the Bucs removed the case to federal court claiming that Mr. Tynes’ claims involved the league’s collective bargaining agreement.  The Court disagreed ruling that the claim related to the Bucs care of its training facility, which was not addressed in the agreement.  Should you have a labor or employment law question, please contact your Tampa Employment Lawyer, Darren D.
